La recherche porte sur les différends commerciaux internationaux. Plus précisément, elle vise à expliquer l'introduction d'une procédure en règlement des différends auprès de l'Organe de règlement des différends (ORD) de l'Organisation mondiale du commerce (OMC). En tant que quasi-juridiction internationale, l'ORD joue un rôle crucial au sein d'un régime multilatéral hautement légalisé. Si cet instrument a attiré une attention croissante, la littérature académique sur le sujet reste pour l'heure principalement axée sur une analyse quantitative établissant diverses corrélations quant au secteur économique, au degré d'intensité des relations commerciales, etc. Un certain nombre d'autres dimensions restent ainsi, pour l'heure, dans l'angle mort de la recherche. Ces lacunes appellent une analyse multidimensionnelle prenant en compte l'influence du processus décisionnel sur la fréquence et le type de « plaintes », l'influence du processus de négociations au niveau international, ou encore l'analyse des normes influant les relations entre partenaires commerciaux. Personne en charge : Josué MATHIEU [Over the past years the world has seen the emergence and strengthening of multilateral institutions. This phenomenon has come with growing legalization of international relations, inducing a need for entities dealing with the settlement of disputes. At the forefront, the Dispute Settlement Body (DSB) of the World Trade Organization (WTO) is of particular interest, as it serves a highly legalized multilateral regime. On this account, the research studies international trade disputes through the explanation of the introduction of dispute settlement procedures before the DSB. Even if an increase in the attention paid to the DSB is noticeable, large gaps remain in the academic literature. On the one hand, studies going beyond the mere correlation of complaints with economic indicators are tremendously scarce. On the other hand, little attention has been paid to the link between the emergence of new powers, most notably India, China, and Brazil, and its impact on the DSB. Hence, this research fills this gap through offering a substantive analysis of the evolution of the patterns of 'complaints' brought before the DSB. The research holds that a multidimensional analysis is needed in order to grasp the complexity of factors explaining the introduction of dispute settlement requests. Moreover, a constructivist perspective that studies the effect of changing identities on the norms governing the interactions related to the settlement of disputes is adopted. While calls for reforms of the DSB are brewing, it becomes, now more than ever, necessary to empirically study the positioning of old and new powers vis-à-vis dispute settlement. Therefore, the study overflows the mere WTO realm and gives clues about the impact of states' growing influence amongst multilateral regimes on the settlement of disputes.
