Unité de Droit familial [Unit of Family Right]
L'Unité de Droit familial est à la base du vaste projet législatif en cours d'élaboration, tendant à la création en Belgique d'un Tribunal de la famille. Elle participe également à la mise sur pied d'une loi réparatrice de la réforme du divorce intervenue en 2007. Sur le plan international, il mène un projet de longue haleine avec l'Université de Montréal, traitant du droit familial comparé. Projet de création, en Belgique, d'un Tribunal de la Famille [Project of creation, in Belgium, of a Family Court]
Ce projet a pour but de rationaliser et mettre fin au morcellement des compétences actuelles, de simplifier les règles de procédures en créant un Tribunal Jeunesse Famille, section spécifique du tribunal de 1ère instance, qui regrouperait l'ensemble des compétences relatives au contentieux familial (mesures provisoires de la crise du couple, autorité parentale, pensions alimentaires, divorce, liquidation-partage, filiation, adoption, etc...) auprès d'un seul juge si possible, tant sur le plan du référé, que sur le plan du fond pour ce qui concerne les litiges civils et d'une chambre de la jeunesse pour toutes les matières découlant de la loi de 1965. [This project aims to streamline and end the current fragmentation of responsibilities, simplify the rules of procedures by creating a Family Court Youth, specific section of the court of 1st instance, which would combine all the skills relating to family disputes (measures temporary crisis of the couple, custody, alimony, divorce, winding-sharing, paternity, adoption, etc ...) with a single judge, if possible, both the interim, and in terms of substantive with regard to civil litigation and a Youth Division for all matters arising from the 1965 Act.]
